1. Acceptance of terms
By accessing or using Aviato (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We may update these terms from time to time and will notify you of material changes by email or in-app notice.
2. Account terms
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
3. API usage
Access to the Aviato API is subject to rate limits and usage policies. You may not use the API to build competing products or to circumvent usage restrictions. We reserve the right to throttle or suspend API access for accounts that violate these policies.
4. Your data and operations
You are solely responsible for the databases you connect, the data you manage through the Service and the actions you and your AI agents run on it. Your use must comply with all applicable laws and our Acceptable Use Policy. We reserve the right to suspend or terminate projects that pose a risk to platform integrity or violate our policies.
5. Payment and billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days’ notice. Usage-based charges are billed in arrears based on metered consumption.
6. Cancellation and termination
You may cancel your account at any time from your account settings. Upon cancellation, your data will be retained for 30 days before deletion. We may terminate accounts that violate these terms or remain inactive for more than 12 months.
7. Limitation of liability
To the maximum extent permitted by law, Aviato shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Governing law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
